These Terms & Conditions (“Terms”) govern all catering orders, services, and interactions provided by Zaika Miami Indian Catering (“Zaika,” “we,” “our,” or “us”). By placing an order, submitting an inquiry, or using our website or services, you agree to these Terms.
1. Catering Orders & Confirmations
- All catering orders must be confirmed in writing (email, invoice approval, or online checkout).
- Orders are considered confirmed only after payment or deposit is received, unless otherwise agreed in writing.
- Menu selections, guest counts, service style, and event details must be finalized by the agreed cutoff date.
2. Pricing & Payments
- All prices are quoted in USD and are subject to applicable taxes, service charges, and delivery fees.
- Pricing may vary based on guest count, menu selection, service staff requirements, rentals, and event location.
- Full payment or a required deposit must be received before the event date.
- Any additional items or last-minute changes may incur extra charges.
3. Guest Count & Minimums
- A minimum guest count or order value may apply depending on the menu or service type.
- Final guest count must be provided by the agreed deadline and will be used for billing.
- Zaika is not responsible for shortages caused by underestimated guest counts.
4. Cancellations & Refunds
- Cancellations must be submitted in writing.
- Deposits may be non-refundable, depending on the timing and nature of the order.
- Refund eligibility depends on notice period, preparation stage, and vendor commitments.
- No refunds will be issued for same-day cancellations or no-shows.
5. Changes & Modifications
- Changes to menu items, quantities, or services are subject to availability.
- Requests made after the cutoff date may be declined or charged additional fees.
- Substitutions may be made if ingredients become unavailable, while maintaining similar quality and value.
6. Dietary Restrictions & Allergies
- We accommodate dietary preferences such as vegetarian, vegan, and Jain options when requested in advance.
- While we take precautions, Zaika cannot guarantee an allergen-free environment.
- Customers are responsible for informing guests about ingredients and potential allergens.
7. Delivery, Setup & Service
- Delivery windows are estimated and may vary due to traffic or unforeseen conditions.
- Setup areas must be accessible and ready upon arrival.
- Zaika is not responsible for delays caused by venue restrictions, elevator access, or parking limitations.
- Service staff hours are billed based on confirmed timelines; overtime may incur additional charges.
8. Equipment, Rentals & Client Property
- Any rented equipment remains the property of Zaika or its partners.
- Clients are responsible for loss or damage to equipment caused by guests or venue staff.
- Zaika is not responsible for personal belongings left at the event site.
9. Food Safety & Leftovers
- Food is prepared following applicable food safety standards.
- Once food is delivered or served, Zaika assumes no liability for food held beyond safe consumption times.
- Leftover food becomes the client’s responsibility after service completion.
10. Force Majeure
Zaika is not liable for failure or delay due to circumstances beyond reasonable control, including but not limited to:
- Severe weather
- Natural disasters
- Government restrictions
- Power outages
- Labor disruptions
In such cases, we will make reasonable efforts to reschedule or provide credit where feasible.
11. Website & Content Use
- All content, menus, images, and branding are the property of Zaika Miami Indian Catering.
- Website images may be illustrative; presentation may vary.
- Unauthorized use or reproduction of content is prohibited.
12. Limitation of Liability
- Zaika’s liability is limited to the total amount paid for the catering order.
- We are not liable for indirect, incidental, or consequential damages.
- Clients agree to indemnify Zaika against claims arising from guest behavior or venue conditions.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
14. Updates to Terms
Zaika reserves the right to update or modify these Terms at any time. Updated Terms will be posted on our website and apply to future orders.
